Currently, DAOs have no legal status in most jurisdictions, but some lawyers are optimistic about the concept as a movement for the modernization of the corporate world. The Howey Test is not used by the Cayman and British Virgin Islands legal system, which is seen as a favorable jurisdiction for DAOs to operate. However, if a DAO is not wrapped into a corporate shell, it could be viewed as a general partnership and individuals involved could be held liable for the actions of the DAO.
